The Criminal Division is located in the Clerk’s office on the 2nd floor of the Dare County Justice Center. This Division is responsible for retaining records of all criminal cases in Dare County, including felonies, misdemeanors and traffic infractions. 

Victims and Witnesses: The District Attorney’s Office assists victims of crimes. Victims and witnesses subpoenaed by the State need to contact the District Attorney’s Office for instructions or concerns. You may reach the District Attorney’s legal assistant at 252.475.5269 for more information. 

Expunction: Petitions for Expunctions are filed in the Clerk’s Office. Not all charges are eligible for expunction. Expunction options vary based upon the criminal charge, type of disposition, and the defendant’s age. Filing fees also vary depending upon the circumstances of your case. While forms may be accessed on nccourts.org, our office cannot advise you as to which form to use or how to fill it out. All inquiries regarding your eligibility, the documentation required to support your petition, and assistance with the expunction process will need to be directed to an attorney.
